Public information is available to the public at a minimum during the normal business
hours of the governmental body. Section 552.002(a) of the Government Code defines “public information” as written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business.
The Texas Public Information Act gives the public the right to request access to government information.
A person may ask to view the information, get copies of the
information, or both. If a request is for copies of information, the governmental body may charge for the copies. ETCOG follows the summary of charges for copies of public information adopted by the Attorney General's office.
While no strict form is required to request public information, certain guidelines must be met. The OAG has set forth tips to help you make a successful Public Information Act request.
Every two years, the OAG publishes an updated Public Information Handbook (PDF). The handbook is free and publicly available.
Both requestors and governmental bodies can call the Open Government Cost Hotline to ask questions about charges under the PIA cost rules.
